Terms of Service

Availability: While we will make reasonable efforts to insure quality service and adequate facilities, we can not guarantee that access to the Internet will be available at all times. We will publish any scheduled outages in advance via e-mail and our web site.

Billing: We will send you an invoice or statement each month. You agree to pay all amounts due by the payment due date specified on each invoice. We may charge to you a late payment fee of $20.00 for each payment not received by the payment due date. We may charge you a finance charge of 1.5% on all amounts past-due. If we refer your account to an attorney for collection, you agree to reimburse us for reasonable attorney fees of 15%.

Cancellation: You may cancel your account at any time by giving us notice via e-mail, fax, postal mail, or telephone. You may not cancel your account by non-payment. Your account may be cancelled by us upon 30 days notice. Your account may be cancelled by us immediately, without notice, and without refund if you violate any of the provisions specified below under Use.

Content: Xaranda Internet, Inc. provides access to the Internet, and does not control, create, censor, or filter any information which may be accessed by the use of its or its upstream providers' facilities, except for the content of its own web site. You may deem some material accessible on the Internet to be unsuitable for children. You agree to take whatever steps you deem necessary to prevent access of any unsuitable material by children, including utilizing blocking or screening software and/or monitoring Internet access by children.

Eligibility: Accounts are available to any person 18 years of age or older, or any lawfully formed legal entity.

Modification: We may modify this agreement from time to time. We will publish the modified agreement on our web site at http://xaranda.net/terms.html.

Payments: All checks accepted for payment must be drawn on a bank located within the United States, and be payable to Xaranda Internet, Inc. in United States dollars. You may provide us with charge card information for any card acceptable to us. If you establish charge card payments, we will collect all amounts you owe us by submitting recurring monthly debits to your charge card account and you agree to supply us with updated information prior to the card's expiration date. You agree to pay a returned payment charge of $20.00 for any check or charge card transaction dishonored by your financial institution.

Privacy: We will treat any personal information you provide us in accordance with our Privacy policy.

Responsibility: You agree to be responsible for all use of your account and to keep your account login name and password confidential. If your password is compromised or disclosed to anyone who should not know it, you agree to notify us immediately.

Severability: If any provision(s) of this agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Use: You may use your account only for lawful purposes. You shall not attempt to access, convert for your own gain, or interfere with the operation of any computer, modem, router, server, or any other device connected to or accessible via the Internet that you do not have the authority to access. You shall not send or cause to be sent any unsolicited commercial or non-commercial bulk e-mail to anyone. Any violation of any provision in this paragraph may result in the immediate cancellation of your account as provided above under Cancellation, and in addition may subject you to civil liability and criminal prosecution.

Venue: You agree that this agreement is entered into by you and accepted by us in North Carolina, and is governed by the laws of the United States and the State of North Carolina.
